Litigation and Settlement of Disputes

The Firm provides litigation services in all types of disputes, where the office and its team represent prominent institutions and individuals in complex and sensitive cases before various courts and judicial and quasi-judicial committees, including corporate disputes, commercial, real estate, civil, insurance, labor, and enforcement disputes, which require precise knowledge and deep understanding of legal and Sharia rulings, in addition to solid experience in the Saudi judicial system, and in handling and preparing cases, and formulating sound defense strategies. Our litigation team members possess proficiency in English, French, and Arabic, with valuable experience that enables them to provide strategic guidance to our clients and assist in complex legal cases. Furthermore, they have deep knowledge and expertise of the legal framework and the Saudi judicial system. Our litigation services include the following:

  • Study the case and conduct legal analysis of the subject matter and relevant documents and hold necessary meetings.
  • Prepare specific and precise structure covering all aspects according to the requirements of the case, determining the classification of the case type and judicial jurisdiction, drafting the facts and events accurately and in detail, legal characterization of the case, stating factual evidence, Sharia and statutory grounds, identifying strengths and weaknesses, assumptions, expectations, and weighting multiple probabilities, reaching the appropriate legal opinion, developing appropriate defense strategies designed according to the nature of each case, and providing appropriate recommendations.
  • Prepare and draft legal memoranda and regulations, preparing rejoinders and reply memoranda, appealing expert reports, preparing objection memoranda before the Court of Appeal, and preparing cassation memoranda before the Supreme Court.
  • Representation in lawsuits and pleading before first-instance, appellate courts and the Supreme Court, as well as all other judicial and administrative committees.
  • Provide advice and prepare necessary documents, applications, objections, complaints, and grievances required before judicial and administrative authorities and all other government agencies.

Out of keenness to preserve and protect business relationships, we also seek to settle disputes through negotiation, mediation, or any other appropriate means.


Arbitration

Arbitration has become one of the most important means of dispute settlement, especially those of a commercial nature, which is why international companies tend to settle their commercial disputes. Our office handles arbitration cases according to extensive experience and fluency in Arabic, English, and French.


Estate Liquidation

The Firm handles all necessary Sharia and statutory procedures necessary for the process of estate liquidation or the exit of any heir from it, starting from obtaining the instrument of inheritance and preparing the determination of the shares among heirs, inventorying estate elements and determining their elements and types, whether they are shares in companies, real estate, or movables...etc, and providing appropriate proposals for amicable or judicial liquidation, as the case may be.


Providing Legal Services Related to Direct and Indirect Tax Systems

The Firm has previously represented clients and provided advice to them in the examination and assessment phase before the Zakat, Tax and Customs Authority (ZATCA), and has also represented clients in their grievances against the Authority's decisions before Zakat, Tax and Customs committees. The Firm has a deep understanding of the tax ecosystem in the Kingdom of Saudi Arabia.
